Temps and Staffers, Inc. (“TSI”, “We”, or “Us”), we are committed to protecting the privacy and security of the personal information of our applicants, employees, clients, suppliers, contacts and the other people we come into contact with. We would like you to know through this notice how we handle and protect the personal information you provided to us with utmost confidentiality and privacy as we comply with the National Privacy Commission RA 10173 Data Privacy Act of 2012.

 

I. WHAT INFORMATION WE COLLECT, ACQUIRE OR GENERATE

 

A. For Applicants and Employees:

When you apply with us, visit our offices or our website, we may collect, store, and use some or all of the following categories of personal information about you. Personal data, or personal information means any information about an individual which could also be considered “sensitive personal information” from which that person can be identified. This information may include but is not limited to the following:

  • Personal contact details such as name, title, addresses, telephone numbers, and personal email addresses
  • Date and place of birth
  • Gender
  • Marital status and dependents
  • Next of kin and emergency contact information
  • SSS, Pag-ibig, and Philhealth numbers including benefits you have availed in the previous company and loans status information (if any)
  • BIR number and tax status information
  • Government documents or clearances such as: Barangay, Police, NBI, etc.
  • Recruitment information (including copies of right to work documentation, references and other information included in a CV/Resume or cover letter or as part of the application process)
  • Employment records (including job titles, work history, working hours, training records and professional memberships)
  • Details from background checks and other due diligence processes
  • Compensation history
  • Biometrics
  • Photographs
  • Social Media Accounts

 

B. For Clients, Partners and Suppliers:

Where our Clients, Partners, Suppliers, or Prospects have chosen to engage with TSI, (“we”, “us”, or “our”), either before or after entering into a business agreement, we are the controller of any personal data about your business or employees that you choose to give us and are therefore responsible for processing it in accordance with the law. This excludes any personal data that you specifically ask us to process as part of the “Services” we will provide.

We respect the privacy of our clients and those individuals working for our clients and recognize that when you choose to provide us with personal data, you trust us to act in a responsible manner with that information. This privacy policy contains important information about how we use personal data for the following data subjects:

  • Our clients, partners and suppliers, either historical, existing or prospective, who are natural persons;
  • Representatives or contact persons of our clients, partners and suppliers who are legal entities.

At times we may request that information is voluntarily supplied to us by our clients, partners and suppliers themselves or by the legal entity appointed by them.

We may gather the following information about you during our engagement:

  • Identification and contact information (full name, title, email, phone, address etc)
  • Job Title, position, and name of company
  • Business Financial information (e.g., bank account details)
  • Identification data relating to the delivery of products or services to our company (e.g., login details, passwords, visitor pass, IP address, online identifiers/ cookies, logs, access times, correspondence)

Clients, partners and suppliers should ensure their employees are aware that their data is being shared with us, as described in this policy.

 

II. WHY WE COLLECT THEM

A. For Applicants and Employees:

TSI uses personal information only as necessary for the purposes for which it was obtained. As such, we may use your personal data in the following instances:

  • To enter into and/or perform our contract or employment obligations with you
  • To enable us to comply with legal obligations
  • In some cases, to pursue other legitimate interests of our own. We may also use your personal information in the following situations, which are likely to be rare
  • Where we need to protect your interests (or someone else’s interests)
  • Where it is needed in the public interest or for official purposes
  • Making a decision about your recruitment or appointment
  • Determining the terms on which you work for us
  • Checking you are legally entitled to work in the Philippines
  • Paying you and, if you are an employee, deducting tax and Government Mandated Benefits
  • Providing the following benefits to you, if applicable:
    • Healthcare
    • Dental coverage
    • Life/Accident insurance
  • Administering the contract or employment relationship we have entered into with you
  • Business management and planning, including accounting and auditing
  • Conducting performance reviews, managing performance and determining performance requirements
  • Making decisions about salary reviews and compensation
  • Assessing qualifications for a particular job or task, including decisions about promotions
  • Gathering evidence for possible grievance or disciplinary proceedings
  • Making decisions about your continued employment or engagement
  • Making arrangements for the termination of our working relationship
  • Education, training and development requirements
  • Dealing with legal disputes involving you, or other employees, workers and contractors, including accidents at work
  • Ascertaining your fitness and/or qualifications to work
  • Managing sickness absence
  • Complying with health and safety obligations
  • To prevent fraud
  • To monitor your use of our information and communication systems to ensure compliance with our IT policies
  • To ensure network and information security, including preventing unauthorised access to our computer and electronic communications systems and preventing malicious software distribution
  • To conduct data analytics studies to review and better understand employee retention and attrition rates
  • Equal opportunities monitoring

With your consent, some of the above grounds for processing will overlap and there may be several grounds which justify our use of your personal information. Where a particular benefit is operated by a third party, they will be a data controller for your personal data and their privacy notice(s) will apply for any applicable benefits you have chosen to access.

B. For Clients, Partners and Suppliers:

The primary reason why we process your personal data is to approve, manage, administer or effect an agreement between TSI and the clients, partners and suppliers you represent or work for. In this respect, we use your personal data, to, issue invoices, perform accounting, manage our contract or review the services or products we supply to you. In addition, we process personal data to meet our legal obligations (such as record keeping obligations), as well as to manage our risks and operations (e.g. prevent and detect security threats, exercise or defend legal claims).

HOW WE STORE, RETAIN AND DESTROY YOUR INFORMATION

We value your privacy that is why we maintain, enforce and implement organizational, physical, and technical security measures to ensure the integrity, confidentiality and security of your personal information. We have put in place appropriate security measures such as end-to-end encryption, technical measures against unauthorized, unlawful, or accidental access or interference, policies on controlling access to said data, data classification, and security measures against external access to prevent your personal information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. We also have procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Details of retention periods for different aspects of your personal information are available in our Data Retention Policy which is available from the Data Privacy Office. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

SHARING AND DISCLOSURE OF INFORMATION

We may have to share your data with third parties, (including third-party service providers and other entities in the group) where required by law, where it is necessary to administer the working relationship with you or where we have another legitimate interest in doing so. If we do share data, we require third parties to take appropriate security measures and only process your data for specified purposes. Disclosure is allowed under Section 12 or 13 of the Data Privacy Act.

RISKS
TSI ensures that adequate organizational, physical, and technical security measures are implemented to protect your personal data. Nevertheless, we cannot guarantee absolute protection of your personal data against certain risks, such as targeted cyber-attacks, ransomware, malware, other similar computer viruses, or unauthorized access to physical records.

YOUR DATA SUBJECT RIGHTS

Rights of access, to be informed, to object, correction, erasure, and restriction.

Your duty to inform us of changes It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your working relationship with us.

Your rights in connection with personal information Under certain circumstances, by law you may have the right to:

  • Be informed about the personal data we hold about you, and details about how we are processing your personal data
  • Request access to your personal information (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
  • Request erasure of your personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it.
  • Request to withdraw your consent at any time. The withdrawal of your consent will not affect the lawfulness of processing based on consent before withdrawal
  • To object, on grounds relating to your particular situation, at any time which is based on our legitimate interest
  • The lawful heirs and assigns of the data subject may invoke the rights of the data subject at any time after the death of the data subject or when the latter is incapacitated or incapable of exercising his or her rights
